Terms and conditions applicable to the use of the Services.

The platform accessible through the domain name www.recram.com (the “Site”) and the services offered through the Site are provided by RECRAM YAZILIM A.S. (hereinafter referred to as “us”, “we” or “us” or the “Company”), a Turkish corporation with a registered address at Muallimköy Mh, Bilişim Vadisi, Deniz Cd. No:143/8-1, 41400 Gebze/Kocaeli and RECRAM INC, a USA corporation with a registered address at 112 Capitol Trail Suite A1127, NEWARK DELAWARE 19711 (US). General

These Terms and Conditions of Service govern the use of the services offered by us, which consist of the creation, publication, subsequent collection, storage and related information management of online forms and such other services as may be offered by us from time to time (the “Services”). The Terms of Use are incorporated by reference into these Terms and Conditions of Service.

In order to use the Services, you will need to create an Account (this term is explained in more detail in section 2.a below) and comply with the other requirements set out in these Terms and Conditions of Service. Please note that the Account also allows you to use functionalities aimed at interacting with the product accessible through the Site. If you decide to use these functions, these Terms and Conditions of Service will apply to you.

Accessing Services; Creating an Account

Eligible individuals

The Services are provided to individuals and companies who conduct business activities in their own right or act as consumers. For the purposes of these Terms and Conditions of Service, a “consumer” shall be construed as any person or company using the Services for a purpose other than conducting a business or commercial activity. If you are creating an account for your company, you understand and agree that such company shall be understood to be the owner of the Account and therefore all content created using the Services and all data collected through the Services shall be understood to belong to your company, unless otherwise agreed between you and your company.

The Services are intended only for individuals who are sixteen (16) years of age or older. By completing the registration forms and making requests for our Services, you warrant and represent that you are of this legal age.

Create an account

In order to access the Services, you will need to register and create an account (“Account”). For this purpose, you must provide true, current, complete and accurate information requested during the registration process that refers to you. You may not register on behalf of a third party or otherwise create an account with us.

If you are an individual, you must create a personal and non-transferable Account that will allow you to use the Services for your personal purposes only.

If you are a company, you must create a business Account that will allow you to use the Services under a company/group name. In this case, you warrant and represent that you may lawfully enter into these Terms and Conditions of Service on behalf of your company. Note that account sharing is not permitted under these Terms and Conditions of Service and therefore you must obtain as many user accounts as necessary for each individual in your organization who uses an Account.

Account Features

If you create an Account, you will be able to choose any of the plans described in the Pricing section of RecRam. Among other functionalities, these plans send an invitation to collaborate with other users who have an Account with us, allowing you to manage workspaces shared with as many Accounts as you choose in your plan. The owner of the paid plan will have limited administrative rights to control content created and managed from other Accounts. When agreeing to be part of your plan, you have a duty to ensure that other users understand the implications for their privacy and content ownership, and you will indemnify, defend and hold us harmless from any costs or damages directly or indirectly related to these matters.

We may provide different plans that offer different functionalities and features and are subject to different pricing terms. The description of the Services may change from time to time and further and more detailed information about the available features and functionalities of the Service is provided during the registration process.

Account ownership is based on the data provided when registering and for this purpose, as noted above, it is important that all information you submit is true, accurate, current and complete. You undertake to notify us of any changes to the information submitted at the time of registration or thereafter in order to keep the information available in our records current and accurate. Remember that when you provide your information and agree to these Terms and Conditions of Service, you are entering into an agreement with us that describes what our obligations are to each other. Provision of Services

Once an Account has been successfully created, the Services will be available and ready for use. Note, however, that access to and use of certain functionality and Services is only available on certain plans and may be subject to payment requirements. We will make any information about these available on the Site.

This section does not prejudice your rights as a consumer under section 7 below – if you are using the Services as a consumer, you have the right to cancel and withdraw from these Terms and Conditions of Service and the Services under the terms and conditions detailed in this section.
