Terms and Conditions of Service

These Terms and Conditions of Service ("Terms") govern your access to and use of the RecRam platform and all related services. Please read them carefully before using RecRam.

1. General / Acceptance of Terms

The platform accessible at recram.com (the "Site") and the services offered through it (the "Services") are provided jointly by:

  • RECRAM INC, a Delaware (US) corporation — 112 Capitol Trail Suite A1127, Newark, Delaware 19711, United States; and
  • RECRAM YAZILIM A.S., a Turkish corporation — Muallimköy Mh, Bilişim Vadisi, Deniz Cd. No:143/8-1, 41400 Gebze/Kocaeli, Turkey

(collectively, "RecRam," "we," "us," or "our").

By creating an account, accessing, or using any part of the Services, you agree to be bound by these Terms, our Privacy Policy, our Cookie Policy, and our Data Processing Agreement, all of which are incorporated into these Terms by reference. If you are using the Services on behalf of a company or other legal entity, you represent that you have the authority to bind that entity to these Terms, and "you" refers to that entity. If you do not agree to these Terms, do not use the Services.

2. Eligibility

The Services are intended only for individuals who are at least sixteen (16) years of age. By registering for or using RecRam, you represent and warrant that you meet this age requirement. If we learn that a user is under 16, we will promptly terminate their account and delete any associated data.

You must also have the legal capacity to enter into a binding agreement in your jurisdiction. If you are using the Services on behalf of an organization, you confirm that you are authorized to accept these Terms on its behalf.

3. Account Creation & Responsibilities

To use the Services, you must create an account ("Account"). When registering you agree to:

  • Provide accurate, current, and complete information during the registration process;
  • Keep your Account information up to date;
  • Maintain the confidentiality of your login credentials and not share them with any third party;
  • Accept responsibility for all activity that occurs under your Account.

If you create an Account on behalf of a company, the company is considered the Account owner and all content created through the Services belongs to the company unless otherwise agreed.

Account sharing is not permitted. Each individual who accesses the Services within your organization must have their own Account. You may invite team members to collaborate within your workspace in accordance with your subscription plan's seat allowance.

You must notify us immediately at info@recram.com if you suspect any unauthorized access to or use of your Account.

4. Description of Services

RecRam is a software-as-a-service ("SaaS") platform that enables businesses and individuals to create, distribute, and analyze interactive video-based communication. The Services include, but are not limited to:

  • Video Forms — Create customizable forms that collect video, audio, text, and file-upload responses from respondents.
  • AI Analysis — Automated transcription, sentiment analysis, visual analysis, and AI-generated summaries of collected responses.
  • Room — Asynchronous video messaging spaces for team collaboration and stakeholder communication.
  • Magnet — Embeddable website widgets that let visitors record and submit video messages directly from your site.
  • Templates — Pre-built form templates for common use cases such as recruitment, customer feedback, and product research.
  • Screen Recording — Built-in screen and camera recording for creating video content within forms and rooms.
  • Logic & Branching — Conditional logic to personalize respondent experiences based on their answers.
  • Integrations — Connections with third-party tools including Zapier, Google Sheets, Google Calendar, webhooks, and the RecRam API.

We may add, modify, or discontinue features of the Services at any time. We will provide reasonable notice before removing any material functionality that you are actively using under a paid plan.

5. Subscription Plans & Pricing

RecRam offers the following subscription plans:

  • Starter — $29 per month (or the equivalent annual rate when billed annually).
  • Professional — $99 per month (or the equivalent annual rate when billed annually).

Each plan includes a defined set of features, usage limits (such as the number of responses, storage, team seats, and AI credits), and capabilities. Full details of what each plan includes are available on our Pricing page.

Add-on bundles are available for purchase to increase your plan's limits — for example, additional team members, storage capacity, or AI analysis credits. Add-ons are billed in the same cycle as your subscription.

All payment processing, billing, invoicing, tax calculation, and compliance are handled by Paddle.com Market Limited ("Paddle"), which acts as the Merchant of Record for all RecRam transactions. When you subscribe, your contractual relationship for payment is with Paddle, and Paddle's terms of service apply to the payment transaction.

There is no free tier. After the free trial period ends, a paid subscription is required to continue using the Services.

6. Payment Terms

When you subscribe to a paid plan, you authorize Paddle to charge your chosen payment method on a recurring basis (monthly or annually, depending on the billing cycle you selected).

  • Auto-Renewal: Subscriptions renew automatically at the end of each billing cycle unless you cancel before the renewal date. Paddle will charge the applicable fee to your payment method on file.
  • Taxes: Paddle calculates and collects any applicable taxes (VAT, sales tax, etc.) based on your billing location. The prices displayed on RecRam may be shown exclusive of tax; the final amount including tax will be shown at checkout.
  • Currency: Prices are listed in US Dollars (USD). Paddle may offer payment in your local currency, and any currency conversion is handled by Paddle.
  • Failed Payments: If a payment fails, Paddle may retry the charge. If payment cannot be collected after reasonable attempts, your access to paid features may be suspended or downgraded.
  • Price Changes: We may adjust pricing from time to time. We will notify you at least 30 days before any price increase takes effect. The new price will apply from your next billing cycle after the notice period. If you do not agree to the new pricing, you may cancel your subscription before the renewal date.

7. Free Trial

RecRam offers a 14-day free trial for new users. No credit card is required to start the trial.

  • During the trial you will have access to the features of the Professional plan so you can evaluate the full capabilities of the platform.
  • The trial begins on the date you create your Account and expires 14 calendar days later.
  • When the trial ends, you must subscribe to a paid plan to continue using the Services. If you do not subscribe, your Account will be placed in a restricted state — you will be able to log in and view your data, but you will not be able to create new forms, collect new responses, or use other active features.
  • Data created during the trial will be retained for a reasonable period (no less than 30 days after the trial ends) to give you time to subscribe or export your data. After that retention period, we reserve the right to delete trial data.

8. Cancellation & Downgrade

You may cancel your subscription at any time from your Account settings or by contacting us at info@recram.com.

  • Effective Date: Cancellation takes effect at the end of your current billing cycle. You will retain access to paid features until that date.
  • Downgrade: If you switch from Professional to Starter, the change takes effect at the start of your next billing cycle. Features exclusive to the Professional plan will become unavailable at that time.
  • Data After Cancellation: After your subscription ends, your Account will enter a restricted state. Your data (forms, responses, recordings) will be retained for at least 60 days after the end of your subscription. During this period you may re-subscribe to regain full access, or contact us to export your data. After the retention period, we may permanently delete your data.
  • No Partial Refunds: Cancellation does not entitle you to a prorated refund for the remainder of the current billing cycle, except where required by applicable law or as described in our Refund Policy.

9. Refunds

Our refund terms are described in our Refund Policy. In general, you may request a refund within 14 days of purchase if the Services did not meet their described specifications, a technical issue prevented proper use and we were unable to resolve it, or a billing error occurred.

Because Paddle acts as the Merchant of Record, all refund requests are processed through Paddle. To request a refund, please contact us at info@recram.com and we will coordinate with Paddle to resolve your request.

10. Intellectual Property

RecRam's Intellectual Property

The Services, including all software, design, text, graphics, logos, icons, images, and the underlying technology, are owned by RecRam or its licensors and are protected by intellectual property laws. These Terms do not grant you any right, title, or interest in the Services except for the limited right to use them in accordance with these Terms.

"RecRam," the RecRam logo, and all related names, marks, and slogans are trademarks of RecRam. You may not use them without our prior written permission.

Your Content

You retain full ownership of all content you create, upload, or collect through the Services ("User Content"), including form designs, video and audio recordings, text responses, images, and any other data submitted by your respondents.

By using the Services, you grant RecRam a limited, non-exclusive, worldwide license to host, store, process, and display your User Content solely as necessary to provide the Services to you. This license ends when you delete your User Content or close your Account (subject to our data retention obligations and backup procedures).

We do not claim any ownership rights over your User Content. We will not use your User Content for marketing, advertising, or any purpose unrelated to providing the Services unless you give us explicit written permission.

11. User Content & Acceptable Use

You are solely responsible for your User Content and for how you use the Services. You agree not to use the Services to:

  • Send unsolicited messages or spam, or use forms or Magnet widgets to collect personal data without proper consent;
  • Upload, share, or distribute content that is illegal, harmful, threatening, abusive, defamatory, obscene, or otherwise objectionable;
  • Collect, harvest, or scrape data from the Services or other users' content without authorization;
  • Attempt to gain unauthorized access to the Services, other users' Accounts, or any systems or networks connected to the Services;
  • Use automated scripts, bots, or crawlers to access or interact with the Services, except through our official API in compliance with its documentation;
  • Interfere with or disrupt the integrity or performance of the Services or the data contained therein;
  • Impersonate any person or entity, or falsely state or misrepresent your affiliation with any person or entity;
  • Use the Services for any activity that violates applicable local, national, or international law;
  • Reverse-engineer, decompile, disassemble, or otherwise attempt to derive the source code of the Services;
  • Resell, sublicense, or redistribute the Services to third parties without our written consent.

We reserve the right to remove any User Content that violates these Terms and to suspend or terminate Accounts that engage in prohibited conduct, with or without prior notice depending on the severity of the violation.

12. AI Services Terms

RecRam offers AI-powered features including automated transcription, sentiment analysis, visual analysis, and AI-generated summaries (collectively, "AI Features"). By using the AI Features, you acknowledge and agree to the following:

  • Technology Providers: AI Features are powered by a combination of industry-leading AI providers, including Google Vertex AI, Google Gemini, OpenAI, and Anthropic Claude. RecRam reserves the right to change, add, or replace AI providers at any time to optimize performance, accuracy, and reliability. Your use of AI Features is also subject to the applicable terms of service of the underlying AI providers.
  • No Guarantee of Accuracy: AI-generated outputs are provided on an "as-is" basis. While we strive for high-quality results, AI outputs may contain errors, inaccuracies, or biases. You should review and verify AI-generated content before relying on it for any decision-making, especially in employment, legal, medical, or financial contexts.
  • AI Credits: Your subscription plan includes a defined number of AI analysis credits per billing cycle. Once your credits are exhausted, you may purchase additional credits through add-on bundles. Unused credits do not roll over between billing cycles unless otherwise stated in your plan.
  • Data Processing for AI: When you use AI Features, your User Content (including video, audio, and text data) is sent to our AI processing providers for analysis. RecRam does not use your data to train or improve any AI models. All AI providers process data in accordance with their respective data processing terms, and RecRam maintains Data Processing Agreements with each provider to protect your information. For details, see our Privacy Policy and Data Processing Agreement.
  • Human Oversight: AI Features are designed as assistive tools, not replacements for human judgment. You are responsible for the decisions you make based on AI-generated outputs.

13. Third-Party Integrations

The Services allow you to connect with third-party applications and services, including but not limited to Zapier, Google Sheets, Google Calendar, webhooks, and the RecRam API. When you enable a third-party integration:

  • You are responsible for reviewing and agreeing to the third party's terms of service and privacy policy;
  • You authorize RecRam to share the data necessary to facilitate the integration (for example, sending form responses to a connected Google Sheet);
  • RecRam is not responsible for the availability, accuracy, security, or performance of third-party services;
  • If a third-party service experiences downtime or a security incident, RecRam is not liable for any resulting data loss or disruption;
  • You may disconnect integrations at any time from your Account settings. Disconnecting an integration does not delete data already shared with the third party.

14. Data & Privacy

Your privacy matters to us. Our collection, use, and protection of personal data are governed by our Privacy Policy, which is incorporated into these Terms by reference.

If you use the Services to collect personal data from respondents (for example, through video forms or Magnet widgets), you act as the data controller for that data and RecRam acts as the data processor. Our Data Processing Agreement governs this relationship and describes the technical and organizational measures we use to protect personal data.

Key security measures include:

  • All data in transit is encrypted using TLS 1.3;
  • All data at rest is encrypted using AES-256;
  • We are committed to GDPR compliance and support data subject access requests, data portability, and the right to erasure.

You are responsible for ensuring that your collection and use of respondent data complies with all applicable data protection laws, including obtaining any required consents from respondents.

15. Limitation of Liability

To the maximum extent permitted by applicable law:

  • RecRam, its directors, employees, partners, agents, suppliers, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses, resulting from (a) your access to or use of, or inability to access or use, the Services; (b) any conduct or content of any third party on the Services; (c) any content obtained from the Services; or (d) unauthorized access, use, or alteration of your transmissions or content.
  • RecRam's total aggregate liability for all claims arising out of or relating to these Terms or the Services shall not exceed the greater of (a) the amount you paid to RecRam (through Paddle) during the twelve (12) months preceding the claim, or (b) one hundred US dollars ($100).
  • These limitations apply regardless of the legal theory on which the claim is based (whether contract, tort, negligence, strict liability, or otherwise), even if RecRam has been advised of the possibility of such damages.

Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, RecRam's liability is limited to the fullest extent permitted by law.

16. Indemnification

You agree to defend, indemnify, and hold harmless RecRam, its officers, directors, employees, contractors, agents, licensors, and suppliers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to:

  • Your violation of these Terms;
  • Your User Content, including any claim that your User Content infringes or misappropriates a third party's intellectual property or other rights;
  • Your use of the Services in a manner not authorized by these Terms or applicable law;
  • Your violation of any applicable law, regulation, or third-party right;
  • Any dispute between you and a respondent or third party arising from data collected through the Services.

17. Service Availability & Uptime

We use commercially reasonable efforts to make the Services available 24 hours a day, 7 days a week. However, we do not guarantee 100% uptime. The Services may be temporarily unavailable due to:

  • Scheduled maintenance (we will provide advance notice when possible);
  • Unscheduled emergency maintenance or urgent security patches;
  • Events beyond our reasonable control, including internet outages, infrastructure failures, or force majeure events;
  • Actions by third-party service providers on which the Services depend.

RecRam shall not be liable for any loss or damage resulting from Service downtime or unavailability except as expressly provided in a separate service level agreement, if applicable.

18. Modifications to Terms

We may update these Terms from time to time to reflect changes in our Services, legal requirements, or business practices.

  • For material changes (changes that meaningfully affect your rights or obligations), we will provide at least 30 days' notice before the changes take effect. Notice will be provided by email to the address associated with your Account and/or through a prominent notification within the Services.
  • For non-material changes (such as clarifications, formatting, or typographical corrections), we may update these Terms without advance notice.
  • The "Last updated" date at the top of this page indicates when these Terms were most recently revised.
  • Your continued use of the Services after the effective date of any changes constitutes your acceptance of the updated Terms. If you do not agree with the changes, you must stop using the Services and cancel your subscription before the effective date.

19. Termination

Termination by You

You may close your Account at any time by contacting us at info@recram.com or through your Account settings. Closing your Account will cancel any active subscription at the end of the current billing cycle.

Termination by RecRam

We may suspend or terminate your Account, with or without notice, if:

  • You breach these Terms or any applicable law;
  • Your use of the Services poses a security risk to the platform or other users;
  • Your Account has been inactive for an extended period (at least 12 months) with no active subscription;
  • We are required to do so by law or a governmental authority;
  • We cease providing the Services entirely (in which case we will provide at least 60 days' notice).

Effect of Termination

Upon termination, your right to use the Services immediately ceases (or at the end of the billing cycle, as applicable). We will retain your data for the period described in Section 8 to allow for data export. Sections of these Terms that by their nature should survive termination — including Intellectual Property, Limitation of Liability, Indemnification, and Governing Law — will remain in effect.

20. Governing Law & Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict-of-law provisions.

Any dispute arising out of or relating to these Terms or the Services shall be resolved as follows:

  1. Informal Resolution: Before initiating any formal proceedings, you agree to contact us at info@recram.com and attempt to resolve the dispute informally for at least 30 days.
  2. Jurisdiction: If the dispute cannot be resolved informally, it shall be submitted to the exclusive jurisdiction of the state and federal courts located in New Castle County, Delaware, United States. You consent to personal jurisdiction in these courts and waive any objection to venue.

If you are a consumer located in the European Union, you retain the right to bring proceedings in the courts of your country of residence in accordance with applicable EU consumer protection laws. Nothing in these Terms limits any rights you may have under mandatory consumer protection legislation in your jurisdiction.

21. Severability

If any provision of these Terms is found by a court of competent jurisdiction to be invalid, illegal, or unenforceable, that provision shall be modified to the minimum extent necessary to make it valid and enforceable, or if modification is not possible, it shall be severed from these Terms. The invalidity or unenforceability of any provision shall not affect the validity or enforceability of the remaining provisions, which shall continue in full force and effect.
